HAVE YOU BEEN EXPOSED TO COVID-19 OR CORONAVIRUS AT WORK?

YOU MAY BE ENTITLED TO BRING A WORKERS’ COMPENSATION CLAIM

Front line and essential workers, such as hospital workers, firefighters, that are at risk of being exposed and contracting Coronavirus due to their jobs may be entitled to have medical expenses covered at 100%, compensation if they are unable to work due to illness, and compensation for any permanent damage that may incur as a result of this virus.

The Illinois Occupational Diseases Act works in conjunction with the Workers’ Compensation Act and offers sick and infected workers many of the same rights and benefits under Illinois Law.

Workers who are exposed and contract Coronavirus in the course of their employment would presumably be covered under the Act.

Generally, these are the requirements to bring a claim:

  1. A positive test result;
  2. Exposure due to work and connection between their employment and contracting the virus;
  3. An increased risk of getting the virus due to the nature of their work.

For some critical workers, there is a presumption that the nature of their work will cause them to contract the virus.  Firefighters, Emergency Medical Technicians, and/or Paramedics will be covered under the Act, unless evidence suggests they contracted the virus elsewhere.
