Officers with the St. Charles Police Department reported that an alleged drunk driving accident that occurred on Nov. 28 resulted in the death of a 65-year-old St. Charles woman. Authorities reported that the collision occurred around 2 p.m. on Second Street near the intersection of Illinois Route 31 and Timbers Trail.

The 23-year-old alleged drunk driver was reportedly driving a Hyundai Santa Fe south on the road when he allegedly crossed the center median and entered the northbound lane. The 65-year-old woman’s Toyota Corolla was then struck head-on by the man’s vehicle.

The woman was transported by emergency medical responders to Delnor Hospital in Geneva, where she succumbed to her injuries. The accused driver was also apparently injured. He was treated and released from Delnor Hospital. Upon his release, he was taken into custody and charged with multiple offenses, including possession of a controlled substance, four counts of aggravated DUI, one count of driving while revoked, one count of driving under the influence of drugs and improper lane usage for his actions in allegedly causing the fatal accident.

Regardless of any criminal action against the driver, the family of the person killed may be able to hold the drunk driver at-fault by filing a wrongful death civil suit against them. By filing such a lawsuit, the family of those killed may be able to recover damages to compensate them for both the economic and noneconomic losses endured as a result of their loved one’s death. When the driver’s behavior was especially reckless and reprehensible, punitive damages may additionally be available.
