La ley, que entra en vigencia el 1 de enero de 2020, prohíbe que el estado migratorio de alguien se use contra ellos de una manera que le impida testificar libremente y con seguridad en un tribunal civil.

El proyecto de ley fue firmado por el Gobernador J.B. Pritzker el viernes 23 de agosto de 2019. Pritzker dijo: “Estoy orgulloso de firmar este proyecto de ley para garantizar que los inmigrantes puedan buscar justicia sin temor. En este estado, tomaremos todas las medidas para proteger a nuestras comunidades de inmigrantes porque son una parte vital de nuestro estado y merecen vivir con dignidad ”.

Si una parte de un caso busca ofrecer evidencia relacionada con el estado migratorio de una persona, debe presentar una moción por escrito que describa la evidencia y el propósito para el cual se ofrece al menos 14 días antes de la audiencia o el juicio. El juez que presidía entonces celebraría una audiencia en privado (a puerta cerrada) para determinar si el estado migratorio es pertinente para el caso. Esa información estaría sellada. Además, la ley hace que el uso del estado con el propósito de intimidar sea un delito menor de Clase C.
